Inspection Limitations and Terms of Engagement This report and the associated inspection are provided in accordance with NZS 4306:2005 Residential Property Inspection (or any superseding standard). The inspection is strictly visual and non-invasive, and the report reflects conditions observable on the inspection date only.

  1. Scope of Inspection
    The inspection is limited to readily accessible areas and components visible without moving furniture, stored items, floor coverings, wall linings, insulation, or any obstructions. No dismantling, probing, drilling, or invasive testing is performed unless specifically agreed and additional fees paid.

  2. Excluded Areas and Components
    The following are excluded from the inspection and report (unless otherwise noted):

    • Concealed elements (e.g., behind finished surfaces: plumbing, drainage, wiring, framing, insulation, ventilation, heating).

    • Underground services, geotechnical/soil stability, or detailed drainage assessment.

    • Asbestos, hazardous materials, environmental contamination, or health/safety risks beyond visual observation.

    • Structural engineering analysis, code compliance certification, valuation, pest inspection, or future performance predictions.

    • Areas inaccessible due to height, confined spaces, weather, occupancy, locked doors, or client restrictions.

  3. Purpose and General Limitations
    The inspection assesses the general condition of the property based on visual observation. It may not detect all defects (existing, latent, past, or developing), gradual deterioration, or issues that require specialist testing. Descriptions indicate existence/condition at the time of inspection, not adequacy, lifespan, or future failure risk. Any item or area not specifically mentioned is excluded from scope.

  4. Moisture, Weathertightness, and Structural Integrity
    No guarantee is provided against present or future moisture ingress, weathertightness failure, structural issues, or related damage. Weather conditions at inspection (e.g., dry periods) may mask leaks or moisture. Thermal imaging/moisture meter use (if included) is indicative only and not exhaustive.

  5. Specialist Advice
    This report is not a substitute for specialist inspections (e.g., structural engineer, electrician, plumber, weathertightness expert). Referrals can be provided where issues are identified outside our expertise.

  6. Body Corporate / Multi-Unit Properties
    For properties under a Body Corporate or similar, the inspection is limited to the individual unit/dwelling. We recommend reviewing Body Corporate minutes, records, and common property details separately.

  7. Weather and Site-Specific Factors
    Observations are based on conditions on the inspection day. Weather can influence moisture detection, and site factors (e.g., boundaries, positioning, future changes) are not assessed or guaranteed.

  8. Reliance and Intended Use
    This report is prepared solely for the named client/recipient and is confidential. No liability is accepted for reliance by any third party, or for any actions/decisions taken based on the report. Do not reproduce or distribute without our written consent.

  9. Liability Limitation
    Subject to any non-excludable rights under New Zealand law (including the Consumer Guarantees Act and Fair Trading Act), our total liability for any loss, damage, claim, or expense arising from the inspection or report (including errors, omissions, or missed defects) is limited to the fee paid for the Services.
    We are not liable for indirect, consequential, or special losses (e.g., repair costs, diminished property value, lost opportunities).
    Any claim must be notified in writing within 7 days of becoming aware of the issue, and legal proceedings commenced within 3 years of the inspection date.

  10. No Warranty. This report does not constitute a warranty, guarantee, insurance policy, or assurance against defects developing post-inspection.

  11. Payment, Booking, and Cancellation

    • Pricing and Quotes: All prices are in NZD and indicative only. A final quote will be confirmed during our free phone consultation, based on property details (size, age, complexity, location, access, travel). Prices may vary if additional factors arise (e.g., difficult access, specialist tools required beyond standard scope).

    • Payment Terms:

      • A 50% non-refundable deposit is required at booking to secure your inspection date and time. This confirms acceptance of the quote and these Terms.

      • The balance is due prior to or on delivery of the final written report (via bank transfer, credit card, or as agreed).

      • Reports will not be released until full payment is received.

      • Late payments incur interest at 15% per annum (or 1.25% per month) on overdue amounts, plus any debt collection or legal costs.

      • All payments are processed securely (e.g., via invoice link or direct credit—no card details stored unnecessarily).

    • Cancellation and Rescheduling Policy:

      • More than 24 hours notice (before the scheduled inspection time): No cancellation fee; deposit fully refundable (minus admin fee $50 for processing).

      • Less than 24 hours notice, no-show, or failure to provide reasonable access (e.g., locked property, unsafe conditions, pets not secured): Full fee charged (deposit forfeited + balance if applicable).

      • We understand unexpected issues can arise—please contact us as soon as possible. Rescheduling may be possible at no extra cost if notice is given early and a new slot is available (subject to availability).

      • If we need to cancel/reschedule (e.g., illness, extreme weather, unsafe access), we'll offer a full refund or alternative date at no extra cost.

    • Refunds: Refunds (where applicable) processed within 7–10 business days to the original payment method. No refunds for completed inspections or reports already delivered.

    12. General

    • These Terms may be updated; the version at booking applies.

    • Governed by New Zealand law. Disputes first via good-faith discussion, then mediation, then NZ courts.

    • As a Licensed Building Practitioner (LBP), we comply with the LBP Code of Ethics—integrity, competence, independence, and client best interest.

    Acceptance: By proceeding (e.g., paying deposit or confirming booking), you confirm you've read, understood, and accept these Terms, including all limitations, disclaimers, and the strict cancellation policy.
